Terms and Conditions
I.Data about the company that owns the website and operates the online store.
The online store hosted by the website www.matrilab.ro owned by SC THERMOFORM PROCESS S.R.L. with headquarters in Calopar Village, Calopar Village, No. 639, Dolj County; C.U.I. RO42034173; registered with the Trade Register under no. J16/3141/17.12.2019, hereinafter referred to as the Company.
The online store is operated in accordance with these regulations, which include in detail the terms and conditions of operation that are supplemented by the applicable legal regulations. These Regulations are provided free of charge.
II.General Provisions
1. These Regulations define in detail the terms and conditions under which the Customer may purchase products through the website www.matrilab.ro. The Company reserves the right to unilaterally modify and update the terms and conditions of these Regulations, even in the absence of agreement or prior notification by the Customer.
2. Browsing this Website and using the online store services implies the User's Consent.
Consent is considered expressed when the User checks the box I agree to the Terms of Service and accept them unconditionally. By expressing Consent, the User declares that he has read this document in its entirety, that he has fully understood and agrees with the meaning and content of the terms and conditions of this document.
3. By accessing the terms and conditions page, you can always read the most recent version of these provisions.
III. General information regarding products, images and promotions The information, respectively the images/photos of the products are for informational purposes, and the delivered products may differ from the images on the site in terms of
color or shade.
The promotions/offers presented on the SITE are valid within the limits of available stock. The promotions are valid for limited periods of time, usually mentioned. If a period of time is not mentioned, they are valid within the limits of available stocks.
The promotions displayed on the site may differ from those in physical stores. The presence of products on the site does NOT guarantee their existence in stock. Our consultants will confirm the availability for each individual product.
SC THERMOFORM PROCESS SRL reserves the right to complete and modify any information on the site.
IV. Company's online sales policy
SC THERMOFORM PROCESS SRL may publish on the site information about products, services and/or promotions practiced by it, during a certain period and within the limit of available stock.
Products and/or services purchased through the online service are intended exclusively for the personal use of the Customer.
SC THERMOFORM PROCESS SRL may limit the ability to purchase certain products or services available on the site at a given time, to one or more Customers.
The minimum accepted value of an order is 100 LEI (excluding shipping fees).
V. Placing orders
By completing the order, the Customer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the order.
By completing the order, the Customer agrees that SC THERMOFORM PROCESS SRL may contact him, for the following purposes / situations:
• Non-acceptance by the issuing bank of the Customer's card, of the transaction, in the case of payments by bank card;
• Invalidation of the transaction by the card processor approved by SC THERMOFORM PROCESS SRL, in case of payment by bank card.
• Validation of the availability of the products and the quantities purchased by the Customer.
• Validation by the Customer of the value of the order placed and including, depending on the situation, other value-added services (e.g. transport, etc.).
• Mutually agreeing on the delivery details of the products.
SC THERMOFORM PROCESS SRL may automatically terminate the order placed by the Customer, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other, in the following cases:
• non-acceptance by the issuing bank of the Client's card of the transaction, in the case of online payment;
• invalidation of the transaction by the card processor, in the case of online payment;
• the data provided by the Client, on the site are incomplete or incorrect
• the Client's activity on the site may and/or cause damages of any nature
• without any justification.
• The customer can cancel an order placed when contacted.
VI.Payment
SC THERMOFORM PROCESS SRL will provide you with the following payment methods, valid only for full payment:
1. Online payment with card
You can make online payment with your personal or company card, in complete safety!
The cards accepted for payment are those issued under the VISA (Classic and Electron) and MASTERCARD logos (including Maestro, if they have a CVV2/CVC2 code).
Regardless of the currency you have in your account, transactions are made in lei, at the exchange rate of your bank.
Card data is processed exclusively through the euplatesc.ro platform.
SC THERMOFORM PROCESS SRL does not request or store any details regarding the card yours.
2. Payment by bank transfer (by payment order).
Payment by Payment Order is made only based on the proforma invoice issued by SC THERMOFORM PROCESS SRL, following telephone or email confirmation of the order with a sales consultant. Delivery of the goods is made after payment confirmation.
Since some Products on the Site may be displayed in error or with a price that can be considered obviously derisory, SC THERMOFORM PROCESS SRL has the right to cancel any orders placed regarding those products, obliging itself to refund to the Customer, as the case may be, any amounts paid up to that moment, with the consequence of refunding the entire amount paid by the Buyer in consideration of the canceled Orders.
All prices for products or services presented on the site are expressed in lei (RON) and include VAT. SC THERMOFORM PROCESS SRL reserves the right to change the price of products/services without prior notice.
The prices displayed on the site crossed out by a line signify the list price, and the uncrossed price is the price that the Customer must pay for the purchase of the product/service, if the products are on sale. Thus, the promotion is highlighted on each product, presenting the initial (crossed) price, respectively the promotion (payment) price.
The invoicing of purchased products is done exclusively in RON using the information provided by the Customer in the intended form. SC THERMOFORM PROCESS SRL is not responsible for the accuracy of the information provided by the Client for the invoice.
In the case of online payments, SC THERMOFORM PROCESS is not/cannot be held responsible for any additional costs incurred by the client, including but not limited to currency conversion fees applied by the issuing bank of his card, if the currency of issue differs from RON. The responsibility for this action lies solely with the client.
If the CLIENT delays the payment of the Goods through his own fault, the delivery term assumed by SC THERMOFORM PROCESS SRL is delayed by the number of days until the payment is made.
3. Refund Payment
It can only be made for orders up to 1400 lei. For orders exceeding the total amount of 1400 lei, payment can only be made online with a bank card or by bank transfer.
VII.Product delivery
Transport
1. Deliveries will be made on average within 1-10 days from placing the order (for products in stock) and 15-90 days for products that are not in stock and are produced specifically for the customer who placed the order, without exceeding the 120-day period.
If the product cannot be delivered, SC THERMOFORM PROCESS SRL undertakes to inform the Customer about this unavailability, and the amounts that the Customer has paid as payment will be reimbursed by SC THERMOFORM PROCESS SRL within a maximum of 14 days.
* Due to the crowding, orders placed (with products in stock) during Black Friday / Christmas / Easter will be delivered in 5-20 days!
2. Delivery to the Customer of small products purchased from SC THERMOFORM PROCESS SRL is carried out through the courier companies DPD/Fan Courier, and the delivery of large products is carried out through the Fan Courier courier company.
3. The value of the delivery cost is calculated depending on the value of the shopping cart and will be displayed before completing the order.
4. SC THERMOFORM PROCESS SRL undertakes to deliver the goods to the CLIENT, who will ensure their proper packaging.
5. The delivery service involves transporting the products to the front of the building/house. Handling them in the home (apartment or house) is the responsibility of the client. The products are delivered in the form of parcels.
6. The delivery service is available only on the territory of Romania!
VIII. Return of products
I. Return of products
The customer (individual) may return the products purchased by order, in the following situations:
•• The packages are severely damaged
•• The products were delivered incorrectly
The consumer has the right to unilaterally terminate the distance contract, without penalties and without invoking a reason, within 14 calendar days from receiving the product or, applying the rules contained in the General Emergency Ordinance. 34/2014.
The Customer is obliged to notify THERMOFORM PROCESS of his intention to return the purchased products, by any means of written communication (e-mail/fax/etc) within a maximum of 14 calendar days from the receipt of the products and/or services. The Customer who notified SC THERMOFORM PROCESS SRL is responsible for ensuring that the products he referred to have been returned or handed over to THERMOFORM PROCESS SRL (or a person authorized by THERMOFORM PROCESS SRL) to receive the products, without undue delay and within a maximum of 14 days from the date on which he communicated to THERMOFORM PROCESS SRL his decision to withdraw from the contract.
The deadline is met if the products are shipped by the Customer before the expiry of the 14-day period, appropriately packaged for protection during transport. The customer is responsible for
proving that he sent the products to THERMOFORM PROCESS SRL, by keeping the document (the product pickup awb) provided by the courier company, at the time of picking up the return, until the legal deadline for reimbursement of the amount.
Through the return form, the customer notifies THERMOFORM PROCESS SRL of the return request, and THERMOFORM PROCESS SRL picks up the products mentioned in the return form and made available by the customer in the following working days, not exceeding the legal 14 days.
In case of refund of the product value, this will be done within 14 calendar days from the registration of the return request, to the bank account provided in writing by the customer.
In case of replacing the product with an identical one, the replacement will be made under the conditions and limits of a normal order. The value of additional services including but not limited to the transport of the products, paid by the customer, will not be refunded.
In all cases, the return/re-shipping costs will be borne by the customer.
The refundable amount, and transferred to the customer's account, will only be related to the ordered items. The transport value will not be canceled.
The cancellation invoice will only include the positions related to the products and not to the transport.
II. Return conditions – SPECIFICATIONS
- Products must be returned in new condition, well packed and protected during transport.
- Products made to order cannot be returned. These products have been made especially for you.
By custom-made products we mean any product that has been personalized according to the customer's preferences (dimensions: length, width, height; material – or any other modification to the standard model presented on the product page, according to article 16, point c, of Emergency Ordinance no. 34/2014.
ATTENTION:
If the products whose return is requested show damage or signs of wear, scratches, bumps or are not returned in the same condition in which they were delivered to the customer, THERMOFORM PROCESS SRL has the right to decide to refuse the return or to withhold an amount from the value of the product, the amount that will be communicated after the assessment of the damages caused to the product by our representatives.
IX. Complaints
Legislation provides a period of 15 calendar days for resolving a complaint!

X. Exclusion of liability
The Company's liability is only engaged in the event of intentional or grossly negligent violation of the Terms and Conditions of this regulation. In all cases, the liability to the Customer for any loss or damage that occurs in connection with an order is limited to the total price of that order.
To the extent that due to an error, the price of a product has been incorrectly entered on the store's website, the Company is not obligated to provide the selected products at an incorrect price. In this case, the Company is obliged to inform the Client immediately.
The Company is not liable for any claims that may arise as a result of erroneous, inaccurate or incomplete, unreal information provided by the User.
All information used to describe the products available on the website hosting the online store (including, but not limited to images, presentations) does not represent a contractual obligation on the part of the Company, these being used exclusively for informational and presentation purposes.
SC THERMOFORM PROCESS SRL cannot be held liable in any way for any losses or damages that anyone may suffer as a result of using in any way the information presented on this website. SC THERMOFORM PROCESS SRL does not guarantee in any way the accuracy, usefulness or completeness of the information or materials contained in this website.
SC THERMOFORM PROCESS SRL does not guarantee the results that may be obtained from the use of the information presented through this website nor the availability for use of any information present on the website.
XI. Protection of personal data
By registering for an account, the User agrees to make available to the Store Operator his/her personal data necessary for the successful completion and completion of the process of purchasing products from the store. Personal data will be used to identify the User, to provide access to the various products and services available.
The User guarantees that the personal data provided is true and accurate and agrees to report in a timely manner any change, modification, update of personal data.
The Company undertakes to respect the confidentiality of the information provided by the User and undertakes not to disclose, provide, communicate this information to third parties, except for the Company's service partners, to whom the transmission of data is necessary in order to complete the order process (including the postal service, the courier service).
The Company has implemented the GDPR as set out in the Privacy Policy which you can access at the following link. By accessing the online store services, the User expressly consents to the processing of his/her data in accordance with the Policy and for the purpose of executing the Contract.
The Company ensures that its own employees respect the confidentiality of the information provided by the Client.

XII. Communication
The User declares that he/she agrees with the means of communication by which the Company conducts its commercial operations, namely by telephone and by e-mail. Any verbal communication will not be effective unless confirmed in writing.
XIII. Force majeure
Neither party shall be liable for failure to fulfill the obligations arising from these regulations if the failure to fulfill is due to a case of force majeure as defined in art. 1351 paragraph (2) of the Civil Code. civ, with the obligation to notify the other party in any way, no later than 5 days from the occurrence of the event.
XV. Applicable law
These regulations are subject to Romanian law in force.
XVI. Final clauses
If a provision of these regulations is null, voidable or is affected by another cause of ineffectiveness, this will not affect the validity and applicability of the other terms and conditions.
